Understanding DVOs in Queensland
A Domestic Violence Order (DVO) is a court order made under the Domestic and Family Violence Protection Act 2012 (Qld) to protect a person (the aggrieved) from domestic and family violence. DVOs impose conditions on the respondent's behaviour, such as prohibiting contact, preventing them from approaching certain locations, or requiring them to surrender weapons.
For a DVO to be enforceable, the respondent must be made aware of the order. This is typically done by personal service of the DVO documents on the respondent.
Documents We Serve for DVO Matters
- Protection Orders — Final DVOs made by the Magistrates Court
- Temporary Protection Orders — Interim orders providing immediate protection until the full hearing
- DVO Applications — The initial application for a DVO
- Variation Applications — Applications to change the conditions of an existing DVO
- Contravention Applications — Court documents where a DVO has been breached
Our Approach to DVO Serving
We understand that DVO matters involve sensitive and often volatile situations. Our approach to DVO serving includes:
- Safety first — Our agents assess every situation for potential risks before attempting service. The safety of the aggrieved person is always paramount.
- Discretion — We serve DVO documents discreetly to minimise embarrassment and potential escalation.
- Prompt service — DVO matters are prioritised for rapid service given the urgency involved in protection matters.
- Detailed documentation — A comprehensive affidavit of service is provided, meeting all Magistrates Court requirements.
- Coordination with police — Where appropriate and requested, we can coordinate with Queensland Police regarding the timing and method of service.
Why Use a Professional Process Server for DVOs?
While police can serve DVOs, using a professional process server offers advantages:
- Faster service — police may take days or weeks depending on their workload
- Dedicated focus on locating and serving the respondent
- Regular updates on service attempts
- Sworn affidavit of service ready for court filing
